Terms of service

These are the terms for buying a website or a monthly plan from Straight Up Web. They’re written in plain English on purpose. By paying for a website or signing up to a plan, you’re agreeing to them.

The website

The standard build covers up to 5 pages, designed around your business and built to work properly on phones. We include one round of changes after you’ve seen the preview, covering adjustments within the original scope. The price is fixed at $500 + GST and nothing is added to it. Work outside that scope, such as more than 5 pages, an online shop with a checkout or logo design, isn’t part of this service; we’ll refer you to ClickTheory instead.

You supply your logo (if you have one), photos and the basics about your business through our form or a short call, and we write the words for each page. We aim to have your site live within about 7 days of receiving everything we need from you. That clock pauses whenever we’re waiting on content, feedback or a decision from you.

Payment

The website is paid up front, by card, through Stripe. Monthly plans are billed automatically each month in advance, and you’ll get a tax invoice for every payment.

Refunds

If you change your mind before we’ve started work, we’ll refund you in full. Once we’ve sent you a design preview, we’ve done the bulk of the work, so we don’t offer refunds past that point, but we’ll keep fixing anything within the agreed scope until you’re happy with it.

Ownership

Ownership of the website, its content and the domain (where we’ve registered it on your behalf) transfers to you once the build has been paid for in full. It’s your site from that point, whether or not you stay on a monthly plan afterwards.

Hosting and Care

Every website includes 3 months of Care hosting. After that, Care continues automatically at $49 a month + GST unless you cancel it beforehand. We’ll email you ahead of the first charge so there are no surprises.

Monthly plans

Care, Grow and Dominate are all month to month, with no lock-in contract. You can cancel any time with 30 days’ written notice (an email to us is enough). Fees already paid aren’t refunded for the current month, but nothing further is charged once your notice period ends.

Google Ads

On Grow and Dominate plans, we set up and manage Google Ads campaigns for you at no management fee, up to your plan’s monthly spend cap. Ad spend itself is paid by you, directly to Google, and is separate from anything you pay us. Above your plan’s cap, we charge 12% of the additional spend for managing it.

No guarantees on rankings or results

We build and optimise your site properly, and we run SEO and Google Ads in good faith, but we can’t guarantee specific rankings, traffic or sales. Search engines and ad platforms are outside our control, and anyone who guarantees you page one is overpromising.

Your content

You’re responsible for making sure any content you give us, including text, photos, logos and claims about your business, is accurate, legal and something you have the right to use. We build the site; we’re not responsible for the accuracy of what you ask us to publish on it.

Liability

To the extent the law allows, our liability to you for any claim relating to these terms or our services is limited to the fees you’ve paid us in the 3 months before the claim arose. We’re not liable for indirect or consequential losses, such as lost profits or lost business opportunities.

Governing law

These terms are governed by the laws of New South Wales, Australia, and any dispute is subject to the jurisdiction of its courts.
